
“On Monday, a federal judge in Manhattan ordered the government not to remove Mr. Khalil from the United States while the judge reviewed a petition challenging the legality of his detention. Mr. Khalil’s lawyers also filed a motion on Monday asking the judge to compel the federal government to transfer him back to New York.” NYT 3/10/25
Lawful Permanent Residents detained by ICE cannot be deported from the US without first being afforded a hearing before an Immigration Judge who will among other matters weigh the seriousness of the alleged criminal record and how long the person has been a Lawful Permanent Resident. A federal Court in New York ordered ICE to return this detainee from New Orleans where he was sent in preparation to be deported from the country. The federal judge ordered ICE to return the detainee back New York where an Immigration Court would have jurisdiction over the matter.
It should be noted this individual has not been convicted of a serious crime at this point.
